Ban on Private Transfer Fees is a Big Win For Georgia REALTORS®! With the passage of House Bill 160, Georgia has officially become the 41st state to pass legislation which bans private transfer fees. Private transfer fees are conveyance fees that require payment of one percent of the selling price to a third party entity every time the property sells for periods up to 99 years. These fees can cost unsuspecting homeowners thousands of dollars in additional closing costs and run the risk of clouding property titles. NAR has long been vocal in its opposition to private transfer fees since there is no oversight on where or how the fees can be spent, how long they are imposed, or on how the fees are disclosed to home buyers. With the assistance of NAR, GAR took a strong position to support the prohibition of private transfer fees and worked hard for the passage of House Bill 160. To ensure the legislation cannot be misinterpreted to restrict payment of real estate commissions, Senator Josh McKoon of Columbus passed a REALTOR® supported amendment on the Senate floor that exempts real estate commissions from the definition of a private transfer fee.
